Odynet Service Agreement


If you choose to rent a DSL modem from Odynet, a deposit of $25.00 (twenty-five dollars) is required at signup.

At termination of service with Odynet, the DSL modem and any accessories originally supplied with the modem must be returned in the original packaging, and in good physical, and working order with in 7 days. Damaged, or incomplete equipment returns, will result in loss of deposit as well as possible additional charges for equipment. If the modem is not returned within the 7 days, your choosen method of payment will be charged for a modem purchase (minus the deposit amount of course)

Your first invoice will include any part month of service to get your account in sync with our monthly billing cycle. Odynet will invoice your account on or about the 20th of the month for the upcoming months service. Most accounts do not have any install fees with them, however dry loops do. This dry loop install fee will normally be charged on your first invoice.
(A dry loop is a dsl service on a line that does not have a phone number associated with it)

User Information. Your messages may be the subject of unauthorized third party interception and review. An individual with Internet access can cause damage, incur expenses and enter into contractual obligation while on the Internet. All such matters are your responsibility. Odynet has no obligation to monitor the service. However, you agree that Odynet reserves the right to monitor the service electronically from time to time and to disclose any information necessary to satisfy any laws, regulation or other governmental request or as necessary to operate the service or to protect itself or others.

No Liability for Content. Be aware that some content, products or services available with or through the service may be offensive to you or may not comply with applicable laws. You understand that neither Odynet nor any of its affiliates attempt to censor or monitor any such content. You understand, however that such content may be subject to “caching” at intermediate locations on the internet when being accessed through the service. You assume total responsibility and risk for access to or use of such content and for use of the internet. Odynet and its affiliates assume no liability whatsoever for any claims or losses arising out of or otherwise relating to access to or use of such content.

Software and Documentation Supplied. Any software or documentation supplied by Odynet or its agents to you to access the internet shall remain the property of Odynet or its agents, as applicable. You shall take appropriate steps to protect against loss or damage. The use by you of any such software and documentation shall be subject to the terms and conditions of any associated software license agreement (“Software License Agreement”) . A copy of the applicable Software License Agreement will either be included with the software or will be presented during the registration or installation process. It is your responsibility to ensure that you review and agree to the terms and conditions of the applicable Software License Agreement before installing or using the software documentation.

Your Equipment. It is your responsibility to ensure that your computer system meets the current minimum requirements stated by Odynet as being necessary to use the service. From time to time, the computer equipment required to access and use the service may change. Accordingly, your computer equipment may cease to be adequate to access the service. In such event, it will be your sole responsibility to upgrade your system accordingly, or to terminate this agreement.

You Can Best Control the Risk and Therefore are Responsible. The fees charged by Odynet reflect the allocation of risk herein and the limited recourse to Odynet provided for in this agreement. Odynet will not assume any responsibility for your acts or omissions or those of any individual who uses your account. As between Odynet and you, you are better able to put in place physical and procedural impediments to the inappropriate use of and to supervise your account. Account and password protection shall be your responsibility. Any detriment that is caused to the network as a result of a failure to properly secure your computer system may result in the termination of your service.

Limited Warranty. The service and any software or other deliverables provided by Odynet and /or its agents are provided “as is” and “as available” without warranties or conditions of any kind. Neither Odynet nor its affiliates warranty the uninterrupted use or operation of the service or any deliverable provided under this agreement. The entire risk as to the quality and performance of the service is with you. Further, neither Odynet nor its affiliates warrant that data or files sent by or to you will be transmitted in uncorrupted form or within a reasonable period of time, that such data or files will not be intercepted, that other users will not gain access to any of your computers equipment, or that any content or other material accessible through the service is free of viruses or other harmful components, or will not be subject to “caching” at intermediate locations on the internet when being accessed through the service.

Termination. This agreement may be terminated by you upon notice to Odynet. Odynet may suspend or restrict the service or terminate this agreement and the service at any time if:
  • the operations or efficiency of the service is impaired by the use of your account; or
  • any amount is past due from you to Odynet; or
  • there has been or is any breach of any term or condition of this agreement.
